As the clock ticks down, a pivotal court case threatens to reshape Fort Worth's landscape for short-term rentals. Almost two years after the city rolled out new regulations governing these properties, a coalition of rental operators is gearing up for a legal battle that could change everything.
The lawsuit, filed in June 2023, consists of 114 plaintiffs who claim that the city is infringing upon their property rights. The operators argue that Fort Worth's regulations effectively ban short-term rentals in residential areas, stifling their ability to earn income from their properties.
In February 2023, the Fort Worth City Council unanimously approved new regulations that significantly restrict short-term rentals. The rules primarily target residential areas, where such rentals are now essentially banned, while imposing stricter guidelines in commercial zones. The lawsuit seeks to block the enforcement of these rules and demands that the city cover the legal fees for the plaintiffs.
In response to the lawsuit, the city has countered by asking for the dismissal of all claims and even requested that the plaintiffs pay for the city’s legal costs. Recently, City Council members voted to triple funding for the city's legal defense in this matter, increasing the budget from $150,000 to $450,000. This funding is expected to be drawn from the city's risk financing fund.
The Fort Worth Short Term Rental Alliance has voiced strong opposition to the city's actions, arguing that the use of taxpayer resources for this lawsuit could be redirected to initiatives that would benefit the community. They contend that the city is overstepping its authority and undermining the rights of property owners.
Fort Worth is not alone in this struggle. Dallas is also embroiled in legal battles over similar regulations that could eliminate approximately 50% of registered short-term rentals in that city. A recent injunction has temporarily halted these regulations, highlighting the contentious nature of short-term rental laws across Texas.
As the December court date nears, all eyes will be on Fort Worth. The outcome could have lasting implications not just for rental operators, but for property rights and local governance in Texas and beyond. Will the court side with property owners, or will the city’s regulations stand firm?
