In a shocking turn of events, the Donna City Council's attempt to dismiss City Attorney Robert Salinas and City Manager Carlos Yerena was abruptly halted by a temporary restraining order (TRO) served during a specially called meeting on Monday. The situation has ignited a firestorm of controversy as allegations of illegal meetings and governance violations come to light.
The TRO claims that certain council members engaged in secret discussions to plot the firings of Salinas and Yerena, which Salinas' attorney, Jay Peña, described as serious breaches of the Texas Open Meetings Act. Peña stated, "These violations undermine the transparency essential for public governance and jeopardize Mr. Salinas' contractual rights, exposing the city to legal peril."
Just a week prior, the council was forced to call an election for two council seats under threat from the 13th Court of Appeals. This election was set against a backdrop of rising tension within the council over the length of term limits that were recently altered from three to four years. The dispute centers around whether this amendment applies to current officeholders or future candidates.
Salinas asserts that the charter amendment is "prospective" and should not affect current officials. However, the council's majority disagrees, creating division within the governing body.
The petition filed against Lugo and Gonzales not only names them as defendants but also identifies the mayor, David Moreno, as a co-petitioner. It accuses the council members of malfeasance for holding non-public meetings to discuss the terminations, a claim supported by Councilman Jesse "Coach" Jackson, who stated he was informed about these secretive discussions after they occurred.
With three out of five council members potentially conflicted due to the allegations, the city's governance is at a standstill. The matter may require intervention by the courts to restore order. Salinas is also seeking financial compensation for the remainder of his salary, which could be significant given his recent contract renewal.
Mayor Moreno expressed concern for the community's trust in local governance, remarking on the repetitive cycle of suspending and reinstating top officials. "For too long, decisions like this have been made in this city, and it’s the people and the community that feel it," he lamented.
