A man named Jeremy Shorr has filed a lawsuit against the Museum of Ice Cream in New York City, claiming that he suffered severe injuries after jumping into the sprinkle pool at the facility. Shorr alleges that the museum was negligent for not warning visitors about the potential dangers of jumping into the pool.
Shorr visited the museum in SoHo with his daughter on March 31, 2023, and sustained injuries when he jumped into the sprinkle pool, which is filled with oversized plastic sprinkles. In his lawsuit, Shorr argues that the museum's advertising and promotional materials created a false expectation of safety for visitors engaging in this activity.
The Museum of Ice Cream, which has multiple locations across the U.S., has not yet commented on the lawsuit. However, Shorr's legal team has pointed to a social media post from the museum's Instagram account in 2019 that encouraged customers to jump into the sprinkle pool as evidence of their negligence.
The museum's website promotes the sprinkle pool as a fun and iconic attraction, showcasing images of visitors of all ages enjoying the pool. Despite appearing to be ankle-deep, Shorr claims that his injuries from the incident required surgery and may necessitate further medical treatment and therapy.
Shorr is seeking damages to cover his medical expenses and legal fees resulting from the incident, highlighting the potential risks associated with seemingly harmless attractions at popular tourist destinations.
