RALEIGH, N.C. (WNCN) - - 6 North Carolina sheriffs are voicing their opposition to two costs proposed in the state house that would need them to more closely work together with federal migration officials.
Both House Bill 10 and Senate Bill 50 would need sheriff's offices to comply with Immigration and Customs Enforcement detainers. They would likewise be needed to report people implicated of specific criminal activities to ICE if their immigration or citizenship status is unknown. Some of those criminal activities include murders, sex offenses, kidnapping, human trafficking and gang activities.
Wake County Sheriff Willie Rowe, Mecklenburg County Sheriff Gary McFadden, Buncombe County Sheriff Quentin Miller, Wilson County Sheriff Calvin L. Woodard Jr., Orange County Sheriff Charles Blackwood and Durham County Clarence F. Birkhead have voiced their opposition to both expenses.
The opposing constables say the proposed pieces of legislation need locally chosen sheriffs to do the job of federal immigration authorities.
A release from the opposing constable's workplaces stated, "They ask state senators and representatives to secure the role of constable, which has historically focused on imposing regional laws in their jurisdictions, preserving and operating prisons, serving civil process documents, and offering security for North Carolinas courtrooms. The sheriffs alert lawmakers that, if passed, HB 10 and SB 50 will endanger their ability to satisfy their regional responsibilities and set a dangerous precedent for overstepping regional authority."
Along with administrative concerns to regional jail and court systems, the constables pointed to concerns about Fourth Amendment rights.
" The expenses do not attend to the potential liability sheriffs will face due to constitutional offenses," said a release.
