A Houston-area homeowners association (HOA) has paused all parking violation enforcement after a family raised concerns that the rules failed to accommodate their disabled son’s needs. The decision comes amid growing scrutiny over whether HOAs are violating federal disability laws by enforcing rigid parking policies.
The Cruz family, residents of the Willow Creek neighborhood, faced repeated fines for parking their van outside their home. Their 10-year-old son, who uses a wheelchair, relies on the van’s accessibility ramp. Yet, the HOA insisted the vehicle violated community rules prohibiting street parking.
After media attention and a warning letter from disability rights advocates, the HOA board called an emergency meeting. The Fair Housing Act (FHA) requires reasonable accommodations for disabilities, which may include parking exceptions. Legal experts suggest the family had a strong case.
"Ignoring federal protections for disabilities can lead to costly lawsuits—HOAs must adjust policies to comply," said attorney Rebecca Sung.
The HOA has formed a committee to revise parking rules, with input from disability advocates. Other communities may face similar challenges as awareness grows.
